AGREEMENT OF RELEASE AND WAIVER OF LIABILITY FORM

I, the participant, (the “Participant” or “I”), understand that in participating in breathwork sessions and other (the “Activities”) offered by Windtuition Wellness INC. (the “Companies”) at its studio location and remote events known as (“Windtuition Wellness”), I agree to the following:

SERVICES & DISCLOSURE.

I understand the Activities offered by Companies are designed to enhance quality of life and support well-being and are not intended to constitute medical advice or any substitution for medical care. I understand that the Activities are not intended to be relied upon for diagnosis or treatment in relation to any health problem, and services of Companies do not replace the care of licensed professionals.

MEDICAL DISCLAIMER & CONTRAINDICATIONS.

I understand that the Activities may involve strong connected breathing, which can result in dramatic experiences accompanied by strong emotional and physical responses. I understand that I may find the Activities physically, emotionally, or mentally stressful, and that the Activities may not be safe under certain medical conditions and are not advised for persons with a history of cardiovascular disease or prior heart attack, high blood pressure, use of prescription blood thinners, epilepsy or seizures, glaucoma, osteoporosis, severe asthma, bipolar disorder, schizophrenia, dissociative disorders, history of significant trauma, or during pregnancy.

I hereby state that I am not pregnant, and if any of the above conditions apply to me, I will not participate in the Activities. I understand that Companies is not qualified to evaluate my fitness for involvement in the Activities, and that I am fully responsible for seeking medical help to treat all symptoms that are present before and after the Activities. I knowingly waive any claim I may have against Companies for injury or damages that I may sustain as a result of participating in Activities.

RISKS.

I understand and acknowledge that the Activities in which I am participating bear certain known inherent risks that contribute to the unique character of these Activities, and that Companies cannot eliminate, alter, or control these inherent risks. “Risks'' include, but are not limited to, known and unknown health conditions, inaccessibility to immediate medical attention, risks inherent in the Activities that include, but are not limited to, over-exertion, psychological distress and disorientation, hyperventilation, respiratory alkalosis, muscle spasms, chest pain, numbness, heart attack, death, and injury or death caused by negligence on the part of Participant or other people around Participant.

I hereby expressly and specifically assume the risk of injury or harm, and agree that my involvement in Activities is purely voluntary, and that I elect to participate in spite of the Risks.

METHODOLOGY, WARRANTIES, & OUTCOMES.

I agree partake in the Activities as proposed and instructed. I understand that Companies has made no guarantees as to the outcome of the Activities, and that information presented before, during, or after the Activities do not constitute a warranty of specific outcomes.

LIMITATION OF LIABILITY.

By using participating in the Activities, I accept any and all risks, foreseeable or non-foreseeable, arising from the Activities. I agree that Companies will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from participation in the Activities or use of any materials provided by Companies.

WAIVER.

By participating in the Activities, I, in my personal name and on behalf of my relatives, heirs, legal representatives, and assigns, hereby agree at all times to release and hold harmless Companies, its affiliates, employees, successors, and assigns, as applicable, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to the Activities. I knowingly and freely assume all risks, both known and unknown, even if arising from the negligence of Companies, and assume full responsibility for my participation in the Activities.

I understand that I may later discover claims or facts that may be different from, or in addition to, those that I now know or believe to exist regarding the subject matter of the release contained in herein, and which, if known at the time of signing this agreement, may have materially affected this agreement and my decision to enter into it and grant the release contained herein. Nevertheless, I intend to fully, finally, and forever settle and release all claims that now exist, may exist, or previously existed, as set out in the release contained in this agreement, whether known or unknown, foreseen or unforeseen, or suspected or unsuspected, and the release given herein is and will remain in effect as a complete release, notwithstanding the discovery or existence of such additional or different facts. I hereby waive any right or claim that might arise as a result of such different or additional claims or facts. I have been made aware of, and understand, the provisions of California Civil Code Section 1542 ("Section 1542"), which provides: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

PERSONAL POSSESSIONS.

Participant agrees that Companies shall not be liable to Participant for any damage to any personal possessions, nor for loss of or damage to any personal possessions by theft, disappearance or otherwise on Companies premises.

LIKENESS AND SOCIAL MEDIA RELEASE 

I grant my permission to Companies to utilize any photographs, motion pictures, 

videotapes, recordings and other reference or records of the activity which may depict, record or refer to me for any purpose (“Likeness”), including commercial use by the released parties, their sponsors and their licensees. This permission is for use internationally and on the internet and for an unlimited period of time. I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of my Likeness and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that my use my Likeness. 

PARTICIPANT KNOWINGLY AND VOLUNTARILY, AFTER DUE CONSIDERATION, ENTERS INTO THIS AGREEMENT OF RELEASE AND WAIVER OF LIABILITY FORM INTENDING TO WAIVE, SETTLE, AND RELEASE ALL CLAIMS OR POTENTIAL CLAIMS THAT PARTICIPANT HAS OR MIGHT HAVE AGAINST COMPANIES.
